Employer sponsorship is when an Australian employer sponsors a skilled worker from overseas to fill a position, they can’t find local talent for. The employer nominates the worker for a visa, allowing them to live and work in Australia. This process is essential for meeting skill shortages in Australia’s labour market. 

What Visas Are Available for Employment Sponsorship? 

There are several visa options available, but the most common employer sponsorship visas include: 

1. Skills in Demand Visa (SID) Subclass 482 – Core Skills 

  • This visa allows skilled workers to live and work in Australia for up to 4 years depending on the length of time the company nominates them for.
  • It’s designed to fill positions in occupations listed on Australia’s Core Skilled Occupation Lists.
  • Applicants need to have a relevant qualification and one years’ experience. If they don’t have qualifications work experience can be used in lieu of qualifications and depending on the occupation this can be from 3 – 5 years.  

2. Employer Nominated Scheme (ENS) Subclass 186

Under the Employer Sponsored Permanent Residence pathways, the two main streams for the ENS Visa Australia are Subclass 186 Direct Entry and the 186 Temporary Transition Stream. 

Both of which involve two stages; nomination by company and visa application by the employee. The company must nominate the position and pay a one-off training levy fee per nomination determined by their turnover. 

Subclass 186 Direct Entry Information 

  • Occupation must be on the CSOL (Core Skilled Occupation List); 
  • Skills assessment required for nominee plus 3 years’ experience at the correct skill level
  • Under 45 years old, unless an exemption applies

Subclass 186 Temporary Transition Stream Information 

  • Open to all occupations – if you hold a 482 visa
  • Must have worked for 2 years on a 482, but if you have changed employers this may be extended as the transfer of the nomination needs to be approved with the new employer before the work can be counted
  • Two stage process, Nomination by company and visa application
  • No skills assessment is required for this pathway

3. Skilled Employer Sponsored Regional (Provisional) Subclass 494

  • This visa supports employers in regional areas to address skill shortages
  • Skills assessment and 3 years’ experience required to be nominated
  • Under 45 years old, unless an exemption applies
  • Occupation can be on the MLTSSL / STSOL occupation lists but must be eligible to apply for this visa

Who Is Eligible for Employer Sponsorship in Australia? 

To be eligible, you typically need: 

  • An occupation on Australia’s Skilled Occupation List 
  • A job offer from an approved Australian employer 
  • Relevant qualifications and work experience for the role 
  • English language proficiency 

Employers must also meet specific requirements, such as being approved business sponsors and demonstrating they cannot find local workers to fill the role.
